It’s Amicus Season: Make the Most of It

Autumn has tightened its chilly grip, and that means one thing – the US Supreme Court is back in session. In 2025-2026 the US Supreme Court will consider the Trump administration’s attempted evisceration of birthright citizenship, a challenge to a majority-Black Louisiana Congressional district, and whether a Colorado law barring “conversion therapy” violates the First Amendment.

Litigation experts will seek community-based organizations (CBOs) to join amicus briefs that illustrate how marginalized communities are harmed by restricting rights in these and other areas.

For CBOs, this presents opportunities – not only to participate in important litigation, but to leverage amicus work for related advocacy that promotes communities’ rights and well-being.

Fine Gauge Strategy has evaluated and studied leading litigators’ amicus work and how amicus participation is utilized by CBOs to strengthen advocacy in other policy venues. A brief primer on ways that CBOs can maximize the value of amicus participation, and how CBOs and their funders can measure and learn from this work, is now available on our Resources Page. We hope it’s helpful. As always, we appreciate your comments.
